Terms of Service

1. What Distill Is

Distill is a thinking development and reflection tool. It helps you capture and revisit your own perspective on content you consume.

Medical disclaimer: Distill is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent anxiety, digital addiction, attention disorders, or any other medical or psychological condition. Users experiencing mental health difficulties should consult a qualified healthcare professional.

2. Your Account

• You must provide a valid email address to create an account.
• You are responsible for maintaining access to your email for authentication.
• One account per person. Do not share your account.
• You must meet the minimum age requirement for your jurisdiction to use Distill: 18 years in India (per the DPDP Act, 2023), 16 years in the EU/EEA (per GDPR), and 13 years elsewhere. If you are under the applicable age, you may not create an account without verifiable parental or guardian consent.

3. Free and Pro Tiers

• Free plan: Up to 10 deep sessions per month. Personal library. Spaced resurfacing (view only).
• Pro plan: Unlimited reflections. Add layers to past thoughts. Weekly digest. Export everything.
• Free tier limits reset on the 1st of each month.
• We reserve the right to modify tier limits with 30 days notice.

4. Acceptable Use

You agree not to:

• Use Distill to store or transmit illegal content.
• Attempt to access other users' data.
• Abuse the API or circumvent usage limits.
• Use automated tools to create accounts or reflections.
• Reverse engineer, decompile, or disassemble the service.

5. Your Content

• You own everything you write in Distill. We do not claim any rights to your reflections or layers.
• We store your content solely to provide the service to you.
• Your content is never used for AI training, never shared with third parties, and never sold.
• You can export or delete your data at any time.

6. Intellectual Property & Enforcement

All rights not expressly granted to you are reserved by Distill and its creators.

• Ownership. The name "Distill", the domain "distillwise.com", all logos, visual design systems, iconography, the spaced-repetition reflection engine, the multi-layer thinking flow, our email templates, landing pages, and all underlying source code are the exclusive intellectual property of Distill and are protected under applicable copyright, trademark, trade dress, and patent laws of India and international treaties.
• No reproduction. You may not copy, clone, mirror, frame, scrape, or create derivative works of any part of the Distill application — including but not limited to UI layouts, color palettes, pricing page structures, onboarding flows, email designs, or marketing copy — without prior written consent.
• No competitive use. You may not use Distill or any information obtained from it to build, market, or operate a competing product or service.
• Domain protection. Registering, operating, or redirecting any domain name that is confusingly similar to "distill", "distillwise", or any variation thereof with the intent to mislead users constitutes a violation of these terms and applicable cybersquatting and trademark laws.
• DMCA & Takedown Policy (Safe Harbor). We respect intellectual property rights. If you believe your copyrighted work has been copied or stored on Distill in a way that constitutes infringement, please submit a written DMCA notice to our Designated Agent at dmca@distillwise.com or legal@distillwise.com containing: (a) identification of the copyrighted work, (b) location of the material on Distill, and (c) your contact information. Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the infringing material.
• Our Intellectual Property. We will issue DMCA takedown notices, domain dispute complaints (UDRP/INDRP), and pursue all legal remedies against any party that infringes Distill's trademarks or proprietary software.
• Scraping & automated access. Accessing Distill via automated means (bots, scrapers, crawlers) for the purpose of copying content, features, or data is strictly prohibited and constitutes unauthorized access under the Information Technology Act, 2000 and the Computer Fraud and Abuse Act.
• License grant to you. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Distill for its intended personal, non-commercial purpose. This license does not include any right to resell, sublicense, or distribute the service.

7. Payments and Cancellation

• Pro subscriptions are billed monthly or annually via Razorpay (India) or Lemon Squeezy (International).
• You can cancel at any time. Your Pro access continues until the end of the current billing period.
• After cancellation, your account reverts to the Free plan. Your data is preserved — nothing is deleted.
• Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge.

8. Limitation of Liability

Distill is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Distill and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service.

Our total liability for any claim arising from these terms or your use of Distill is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via the email associated with your account. Continued use of Distill after changes take effect constitutes acceptance of the revised terms.

10. Governing Law

These terms are governed by the laws of India. Any disputes arising from these terms or your use of Distill shall be subject to the exclusive jurisdiction of the courts in India. This does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
